Public Performance and Determinations
The U.S. Department of Education, Office of Special Education Porgrams (OSEP) is required under the Individuals with Disabilities Education Improvement Act (IDEA) to place each State in one of four levels of determination: Meets Requirements, Needs Assistance, Needs Intervention, and Needs Substantial InterventionThese determinations are based on information gathered through the state's progress on each of the compliance indicators (1, 7, 8a, 8b, 8c, 9, 10 and 11) as reported within the Annual Performance Report (APR). Colorado submits an APR to the Office of Special Education annually on February 1.
Similarly, the Colorado Department of Human Services, Division for Developmental Disabilities, as lead agency for Colorado's Part C program makes determinations for the twenty Community Centered Boards. These determinations are based upon the following criteria: Performance on certain SPP indicatorsNature and length of time regarding correction of any noncompliance—1 yearData—timely, reliable, and validDispute resolutionAlthough not a requirement, Colorado publicly reports the local determinations.
